GENERAL SERVICE CONDITIONS

FANTÀSTIX (legal name GESTIÓ CULTURAL TRANSVERSAL, S.L., Tax ID No. B64507809; hereinafter, “FANTÀSTIX”) provides this document to users with the purpose of regulating the contracting of services offered through the website and complying with the obligations established in Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSICE), as well as informing all users of the terms of use of the website.

Any person accessing the website www.fantastixsuper3.com  assumes the role of User and undertakes to strictly observe and comply with the regulations stated herein, as well as with any other applicable legal provisions.

FANTÀSTIX reserves the right to modify, unilaterally and at any time, the information and the conditions set forth in this document, without any obligation to give prior notice to users, with publication on the FANTÀSTIX website being sufficient. Notwithstanding the foregoing, contracts already formalised shall be governed by the conditions in force at the time they were concluded.

By accepting these conditions, the User declares that they have read, understood and comprehended all the provisions, that they possess the necessary legal capacity to contract, and that they accept and undertake all obligations established herein.

2. USE OF THE ONLINE TICKET SALES PLATFORM

Any person accessing or using the FANTÀSTIX online ticket sales platform acquires the status of User and, once the purchase has been completed, also the status of Client. Mere browsing and/or the execution of any transaction through this platform implies the full, express and unreserved acceptance of these General Contracting Conditions, which apply regardless of any other general conditions that may be mandatory under applicable legislation.

It is not necessary to create an account in order to purchase tickets.

3. ONLINE TICKET PURCHASE

FANTÀSTIX provides the public, through its website www.fantastixsuper3.com  with an EUROMUS 9 online ticketing platform (hereinafter, “Online Tickets”), managed by CCALGIR, S.L., Avda. Sant Francesc 13, 17001 Girona.

Through this system, Online Tickets may be purchased for access to the facilities, visits, activities, events or any other actions conducted at FANTÀSTIX and made available for sale on the website. As capacity is limited and admission takes place in timed slots, the ticket is valid exclusively for the selected date and time, and strict punctuality is required. Arrival outside the designated time slot will be subject to availability and may result in a reduction of the visit duration or, in exceptional cases, the loss of the right of admission.

The User is solely responsible for accurately providing their data during the purchasing process enabled on the ticket sales platform. No account creation is required. Once the purchase has been completed, the User will receive an email at the address provided and may:

• print the tickets in paper format, ensuring that the codes identifying each ticket are completely legible; and/or
• download the PDF file to their mobile device.

Any ticket purchase made through the designated website implies the User’s prior and express acceptance of these General Contracting Conditions. The User must tick the acceptance box appearing during the purchase process before payment, as well as accept any specific conditions indicated.

Tickets, regardless of the medium used (paper or digital), have the same validity as those purchased at the ticket office and, upon presentation, grant access to the facility or activity corresponding to them. These tickets are valid for a single use only.

During the Online Ticket purchase process, operational notices or instructions necessary for the proper conduct of the visit or activity may be displayed. The User must follow the indications provided by FANTÀSTIX and is responsible for ensuring full compliance. Failure to comply with such notices or conditions will exempt FANTÀSTIX from providing the service or offering any alternative solution; any possible rescheduling will be subject to the availability of capacity at that time. Under no circumstances will non-compliance entitle the User to a refund of the ticket price.

FANTÀSTIX may require visitors who have purchased Online Tickets under special rates—based on age or other conditions applicable at the time of purchase—to provide documentation accrediting such conditions. Failure to provide proof will result in the denial of access to the facility, unless the difference between the amount paid and the full, non-discounted price is settled in advance.

4. TAXES

The prices indicated include VAT and any other applicable taxes in force at the time of purchase.

5. CHANGE AND REFUND POLICY

Once the tickets have been purchased by the User, FANTÀSTIX will not accept cancellations with a refund of the amount paid. Tickets are non-refundable. For further information or clarification, Users may contact info@fantastixsuper3.com 

The purchase of Online Tickets is not subject to the right of withdrawal (Articles 103.l) and 97.1.l) of Royal Legislative Decree 1/2007 of 16 November, approving the Consolidated Text of the General Law for the Defence of Consumers and Users). Consequently, no refunds will be accepted under any of these circumstances.

The cancellation and refund policy applicable to modalities other than individual tickets (e.g., group bookings, private events, or other specific products) shall be that set out in the contracts or specific communications of the corresponding purchase process. If no such policy is specified, the present policy shall apply.

FANTÀSTIX reserves the right to cancel or modify activities, sessions or events due to force majeure or for reasons beyond its control, without prior notice and without generating any right to compensation. Whenever possible, FANTÀSTIX may offer a rescheduling subject to availability, without any obligation to issue a refund.

6. PROHIBITION OF TICKET RESALE

The resale, transfer, or commercialisation—whether for consideration or free of charge—of Online Tickets outside FANTÀSTIX’s official channels is expressly prohibited.

Likewise, the publication, dissemination, hosting, or making available of tickets, their codes (bar/QR), or any information or content associated with them on terminals, servers, websites, apps, social networks or third-party platforms, including marketplaces or resale portals, other than FANTÀSTIX’s official channels, is prohibited without prior written authorisation.

Consequently, FANTÀSTIX reserves the right to block or restrict the use of the service for users who misuse it or for whom there are indications of fraudulent use; to cancel and/or invalidate the affected tickets; and to deny access to the facility, all without the right to refund and without prejudice to any legal actions that may apply.

7. CONDITIONS OF ACCESS AND STAY IN THE FACILITIES

Admission requires presenting, at the access point, the corresponding ticket purchased via the FANTÀSTIX online ticketing platform, in good condition, either in digital format on a mobile device or printed on paper. Admission is, in all cases, subject to the ticket being complete, perfectly legible and free from manipulation.

The ticket is valid exclusively for the date and time selected at the moment of purchase. Access is organised in time slots and strict punctuality is required. Arrival outside the assigned time slot will be subject to availability and may result in a shorter visit duration or, in exceptional cases, loss of the right of admission.

FANTÀSTIX reserves the right to cancel or modify visits, activities or sessions without prior notice due to unforeseen circumstances of force majeure or for the performance of official or other unavoidable events. In such cases, and in line with the change and refund policy, a rescheduling may be offered subject to availability, without generating any right to compensation or refund.

FANTÀSTIX also reserves the right to refuse admission or to immediately expel any person who commits a serious or repeated breach of internal rules or displays inappropriate behaviour. Access may be restricted or expulsion may occur for users who:

• exhibit violent, discriminatory or aggressive behaviour, or provoke disturbances outside or at the entrance of the building.
• carry objects that could be used as weapons or elements inciting violence.
• show signs of intoxication or consumption of illegal substances.
• wear clothing, objects or symbols inciting violence or promoting activities contrary to fundamental rights or disrespectful towards others.

Violation of these rules or engagement in actions that may cause damage, harm, or pose a risk to the safety of people or property—either at the moment of entry or during the visit—will entitle FANTÀSTIX to proceed with immediate expulsion, without any right to a ticket refund.

Minors under eighteen (18) years of age must be accompanied by an adult and remain accompanied throughout the entire visit.

8. PERSONAL DATA PROTECTION

FANTÀSTIX (legal name GESTIÓ CULTURAL TRANSVERSAL, S.L., Tax ID No. B64507809) guarantees full compliance with Regulation (EU) 2016/679 of 27 April (GDPR) and with Organic Law 3/2018 on Personal Data Protection and the Guarantee of Digital Rights, in relation to the processing of personal data collected during the ticket purchase process, as well as for access control and visit management. Data will be processed solely for these purposes and in accordance with what is established in the Privacy Policy.

The rights of access, rectification, erasure, restriction of processing, objection and data portability are recognised, and may be exercised through the channels indicated in the aforementioned Policy or by contacting info@fantastixsuper3.com 

Users are reminded that the personal data provided through the website must be truthful, accurate, complete and up to date; the User is responsible for their accuracy and for updating them whenever necessary.

9. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

All content, trademarks, logos, designs, photographs, texts, audiovisual materials, computer programs (including source code and object code), databases and, in general, any element appearing on the FANTÀSTIX website are protected by intellectual and/or industrial property rights, which are expressly reserved by GESTIÓ CULTURAL TRANSVERSAL, S.L. (FANTÀSTIX) or, where applicable, by their respective authors or rights holders. Any infringement of these rights will be pursued in accordance with applicable legislation.

The reproduction, exploitation, transformation, alteration, distribution, public communication, making available, extraction or reuse —by any means or for any purpose— of the website’s content for uses other than legitimate information or the contracting of services by users is strictly prohibited. Likewise, “framing,” “scraping” or large-scale indexing of content, as well as the removal or manipulation of rights notices, are prohibited. In any case, prior written consent from FANTÀSTIX is required.

10. LIABILITY

FANTÀSTIX accepts no responsibility for information published on its website if such information has been altered or inserted by an unauthorised third party. Likewise, it shall not be liable for any damages or losses of any kind arising from causes beyond its control; by way of example and without limitation, FANTÀSTIX is not responsible for the unavailability of the portal, technical incidents, or errors or failures in payment systems agreed with financial institutions, nor for any errors within such systems.

The website may redirect users to third-party content. As FANTÀSTIX cannot permanently control content introduced by third parties on their respective websites, it assumes no responsibility for such content. In any case, it will proceed to the immediate removal of any link or redirection to content that may contravene applicable law, moral standards or public order, and will inform the competent authorities where necessary.

FANTÀSTIX is not responsible for information and content stored —including but not limited to— in forums, chats, blog generators, comments, social networks or any other medium that allows third parties to publish content independently of FANTÀSTIX’s website. Nevertheless, FANTÀSTIX remains available to Users and to law enforcement authorities to collaborate actively in the removal or blocking of any digital content that may violate national or international legislation, third-party rights, moral standards or public order. Should a User consider that the website contains any such content, they may notify the website administrator immediately via info@fantastixsuper3.com 

11. REVISION OF CONDITIONS

FANTÀSTIX reserves the right to review and modify these conditions at any time. The User shall be subject to the policies and conditions in force at the time of using the website or placing each order, except where changes must be applied retroactively due to legal mandate or decision of a competent authority. Without prejudice to the foregoing, contracts already concluded shall be governed by the conditions in force at the time of their formalisation, unless otherwise required by applicable law.

12. APPLICABLE LAW AND JURISDICTION

The interpretation of these legal terms and any matter related to the services provided through the website shall be governed by Spanish law and, where applicable, by Catalan regional regulations.
